Approvata e pubblicata sulla Gazzetta Ufficiale la legge quadro per l’autonoleggio bus.
Provvedimento storico che sicuramente ridurrà l’abusivismo

Con la pubblicazione, sulla Gazzetta Ufficiale del 18 agosto 2003, della legge quadro “Disciplina dell’attività di trasporto di viaggiatori effettuato mediante noleggio di autobus con conducente” si apre una prospettiva nuova per l’attività di noleggio bus che trova finalmente riconosciuta la sua identità e si definiscono regole più precise e stringenti, per le imprese e per gli autisti, che ridurranno sicuramente i fenomeni di abusivismo fortemente presenti nella categoria.
Scopo principale della legge è garantire la trasparenza del mercato, la concorrenza, la libertà di accesso delle imprese al mercato, il libero esercizio dell’attività in riferimento alla libera circolazione delle imprese, nonché la sicurezza dei viaggiatori trasportati e l’omogeneità dei requisiti professionali.
E’ un risultato storico che si realizza dopo oltre dieci anni di richieste e proposte avanzate dalla Claai e dalle altre Associazioni dell’Artigianato e delle Pmi.
Ora, fatta la legge quadro, spetta alle Regioni il compito di emanare importanti provvedimenti di recepimento.
In particolare, le Regioni devono adottare atti legislativi per:
stabilire le modalità per il rilascio delle autorizzazioni. L’attività di noleggio di autobus con conducente è subordinata al rilascio, alle imprese in possesso dei requisiti relativi alla professione di trasportatore su strada di viaggiatori, di apposita autorizzazione da parte delle Regioni o degli enti locali allo scopo delegati. Tale autorizzazione consente lo svolgimento professionale dell’attività di noleggio di autobus con conducente e l’immatricolazione degli autobus da destinare all’esercizio e non è soggetta a limiti territoriali. L’esercizio dei servizi internazionali è subordinato al possesso, da parte del titolare, dell’attestato di idoneità professionale esteso all’attività internazionale. Copia conforme dell’autorizzazione deve essere conservata a bordo di ogni autobus che è stato immatricolato in base ad essa;
fissare le modalità e le procedure per l’accertamento periodico della permanenza dei requisiti previsti dalle norme comunitarie e nazionali per lo svolgimento dell’attività;
istituire il registro regionale delle imprese esercenti l’attività di trasporto di viaggiatori mediante noleggio di autobus con conducente ed inviare annualmente al Ministero delle infrastrutture l’elenco delle imprese titolari delle autorizzazioni con la specificazione del numero di autobus in dotazione.
Anche i conducenti degli autobus adibiti al servizio devono essere facilmente individuati. Infatti, gli autisti possono essere lavoratori dipendenti, lavoratori con contratto a termine o altre tipologie contrattuali per lavoro temporaneo consentite dalla legge, titolari, soci e collaboratori familiari di imprese titolari delle relative autorizzazioni. La qualità di dipendente o di lavoratore con altra forma di contratto deve risultare da una dichiarazione, resa a norma di legge, del legale rappresentate dell’impresa dalla quale, nel caso di lavoratore dipendente, risultino gli estremi della registrazione a libro matricola e il rispetto dei contratti collettivi. Tale documentazione deve essere in possesso del dipendente e del lavoratore in servizio.
La qualità di titolare, socio e collaboratore familiare deve risultare dal registro delle imprese presso la locale Camera di Commercio.
Tale ultima norma che individua con precisione i conducenti ci sembra un buon inizio per limitare il lavoro nero e/o il doppio lavoro e aumentare la qualificazione del personale addetto determinando, certamente, una maggiore sicurezza sulla strada e dei viaggiatori trasportati.
Nel complesso la legge in questione è, senz’altro, un provvedimento significativo che produrrà effetti positivi per le imprese, per gli utenti e per i lavoratori.
In Campania le nuove norme interessano circa 1000 imprese con un parco autobus, in gran parte da turismo, stimabile in diecimila mezzi e con circa cinquemila addetti.
Il nostro compito, come Claai, è sia quello di incalzare la Regione Campania affinché nel più breve tempo possibile adotti i dovuti atti legislativi sia quello di attrezzare appositi sportelli per assistere nel migliore dei modi le imprese di noleggio bus.
